A Cary man charged with criminal sexual assault is accused of raping a woman whom he knew after a night out drinking, police say.
Miguel Hernandez remained at the McHenry County Jail on Friday afternoon on a $105,000 bond. Police arrested the 30-year-old on Thursday in connection with a rape allegation, which officers began investigating in July 2017.
Hernandez, of the 1000 block of Nighthawk Way, was drinking with a 23-year-old woman on July 9, 2017, McHenry Police Public Affairs Officer Patrick Polidori said.
The woman called police about 5:30 a.m. that same day and reported that Hernandez had sexually assaulted her, Polidori said.
The initial investigation took several months, but police eventually filed one count of criminal sexual assault against Hernandez.
The charge is a felony, which is typically punishable by as many as 15 years in prison.
Officers had trouble locating the man because he’s believed to have moved shortly after the alleged assault, Polidori said.
Before his arrest Thursday, Hernandez had been wanted by police since Nov. 1 for allegedly sexually assaulting a woman who could not give consent, public records show.
Hernandez’s attorney, McHenry County Assistant Public Defender Richard Behof, could not immediately be reached for comment Friday afternoon.
The case will pick back up in McHenry County court on Monday.
