Spring Grove man convicted in fatal DUI jailed while awaiting sentence

The family of fatal crash victim Tanya McDonough cried Friday as the alleged drunken driver responsible for her death was ordered to remain in jail until a sentencing hearing next month.

Ryan Heineman of Spring Grove has been free on bond since February, when a jury convicted him of aggravated driving under the influence in connection with 33-year-old McDonough’s death.

Heineman arrived in court Friday morning with hopes to substitute his trial attorney, Martin Lascola, with a new attorney, Raymond Wigell, who he felt was better equipped to handle his post-trial requests.

Prather denied Heineman’s request, calling it a “delay tactic” meant to push back his sentencing while the new attorney familiarized himself with the case.

Instead, Prather allowed both attorneys to work together on Heineman’s post-trial requests and rescheduled the sentencing for April 26.

Because Prather only agreed to release Heineman on bond until what she believed would be an April 5 sentencing hearing, she revoked the 36-year-old’s bond Friday and had him returned to the McHenry County Jail.

Heineman could be sentenced to as many as 14 years in prison for driving under the influence the morning McDonough was thrown from the vehicle he was driving and died. Heineman would be required to complete at least 85 percent of the prison term under truth in sentencing guidelines.
